In these Terms&Conditions:
"Goods" means those products made available by Direct Vizion
that you wish to purchase, as indicated in your Order.
"Order" means orders placed in accordance with the provisions
of Section 3.1.
"Site" means the website owned and operated by Direct Vizion
at the URL address of http://www.directvizion.co.uk
1. Customer
Obligations
1.1 That you
are aged 16 and over and you are not registered blind or partially sighted.
1.2 That you
are in possession of a written prescription for your spectacles, it must be
signed by a medical practitioner or a registered optometrist. The prescription
must be within the date of recall as recommended by the person who carried out
your sight test.
1.3 To
supply full and accurate details of your current prescription including any
additional notes.
1.4 That you
do not intend to purchase goods with the intention of resale or use in any
other way than your own personal use.
1.5 To
provide up to date contact details and are the authorised holder of a
credit/debit card or have the permission of the card holder to make payments on
the website.
2.
Availability and Description of Goods
2.1 Direct
Vizion shall make every effort to fulfill orders made, however we cannot
guarantee the availability of goods. Should the goods you have ordered be
unavailable the customer shall be informed immediately. The customer will be
given the option of choosing a replacement or offered a full refund. If we do
not receive a response then Direct Vizion may, at its complete discretion,
provide replacement goods of similar quality and specification or cancel the
order and provide a refund.
2.2 Direct
Vizion may under the advice of opticians, have absolute discretion whether or
not to accept an order. They will inform you of their decision and may discuss
other options with you or contact your medical practitioner or registered
optometrist to verify/discuss the prescription.
2.3 All
prices and specifications are correct as seen. Direct Vizion reserve the right
to alter prices and specifications without notice. Customers who have already
ordered before any such change will have their order fulfilled at the price
appertaining to the order date.

Orders for Goods
3.1 Orders
must be placed:
3.1.1 via the ordering system on the Site;
3.1.2 by telephoning Direct Vizion on 0116 216 6585
3.1.3 In person at our new store
3.1.4 or by completing an order form and posting it to:

3.2 Your
submission of the Order, as stated in section 3.1 represents an offer to
purchase the Goods from Direct Vizion. Direct Vizion may confirm receipt of
this offer via email (if the Order is placed via the Site) or verbally (if the
Order is placed via telephone). Any confirmation of receipt of the Order will
not constitute an acceptance by Direct Vizion of your Order.
3.3 There
will be no binding contract between you and Direct Vizion for the supply of
Goods until the Goods have been sent to you by Direct Vizion.
3.4 You may
change your Order at any time until the Goods are sent by contacting Direct Vizion
by email, telephone, or mail. You must let us know of any changes as soon as
possible, because we process orders very rapidly.
4. Payment
and Delivery
4.1 The
price payable will be the price as quoted on the website as stated at the time
of your order.
4.2 All
prices are in pound sterling and include VAT.
4.3 The
price of our postage and packaging is clearly shown on our website before your
order is confirmed by yourself.
4.4 If your
order is accepted by Direct Vizion delivery will take place no later than
twenty eight (28) days.
5. Returns
5.1 Upon
delivery please inspect the goods you have ordered. If any of the goods do not
match the description or appear to be damaged do not use the goods. Please
contact us immediately over the phone or by email for instructions.
5.2 If for any
reason you are unsatisfied with the goods you have ordered then you have 14
days in which to return the item in question.
5.3 We do
not accept any responsibility and will not be liable for any damage to the
goods caused by the customer once the goods have been received.
6. Money-back guarantee
6.1 Money
back guarantee is subject to goods being returned in substantially the same
condition as when received by you, we will reimburse you within thirty (30)
days of the day on which returned goods are received by Direct Vizion. Such a
refund will include the total price paid for the goods but shall not include
any costs of returning the goods to Direct Vizion such as postage and packing.
Monies will be refunded by the same method of payment as originally paid to
Direct Vizion.
6.2 No
monies will be refunded if:
6.2.1 the returned goods are not received as new by Direct Vizion
6.2.2 you
are in breach of your obligations under these terms and conditions
6.3 You must send your glasses back within 14 days
in substantially the same condition as received by you for a refund.
7. Glazing service
7.1 All frames sent for re-glaze are sent on owner’s
risk. Direct Vizion will not be held accountable in the very unlikely event of
loss or damage to the frame.
7.2 Direct Vizion may to its own discretion offer
upto a maximum of but not exceeding £30 voucher in the event of loss or damage
to a customer’s frame which was sent for a re-glaze. This voucher is only
redeemable at Direct Vizion within a period of 14 days from date of issue.
7.3 Once you place your order for glazing service,
the customer must notify Direct Vizion immediately of any change of mind, and
or errors/mistakes made when sending your prescription.
7.4 Once your order has been sent to the
laboratory, Direct Vizion can not make any changes to your prescription and is
not obliged to offer any refunds, as the lenses are custom made to customer's
prescription. However, until further notice, Direct Vizion has decided to offer
all its customers 100% money back guarantee, even if the customer is at fault.
8. Try at home service
8.1 The customer will pay the full price of the
frame when requesting glasses to try at home. The glasses must be returned
within 14 days in substantially the same condition as received by you.
8.2 No monies will be refunded if you are in breach
of these terms and conditions (8.1).
8.3 All try at home glasses that are returned for a
refund will not incur a £2.99 postage and packaging charge deductible from the
original amount paid.
8.4 All returns must be sent using Royal Mail
recorded delivery or Royal Mail special delivery, as Direct Vizion cannot be
held accountable for goods damaged or lost in transit.
